Private tile hearing in DD#131 may set land crossing precedents

The county supervisors, acting as drainage trustees, presided over a hearing to cross private land in DD#131 at their regular meeting on Monday. Brian Wagner, a landowner in section 27 of Dayton Township, was petitioning the trustees to cross 700 feet of land owned by Gary Robb, also in section 27. The hearing will be continued at next week’s meeting. According to Dave Johnson, legal counsel to the trustees, the decision they announce then may set precedent for interpretation of drainage code in the county.

Seventy acres owned by Beyer Family Trust were annexed into DD#131 in August of last year. Wagner said that after the annexation, pattern tile had been installed on Beyer-owned land, as was their right, but that made the district main even more full. “That land up north that was annexed in is loading up that 10- inch tile to where there’s no room in it,” Wagner said.
